Introduction

1.1 The sale of MOJAVE products through the MOJAVE website (hereinafter referred to as the “Website”, the seller -  “LAZEBNYK DMYTRO ROMANOVYCH» EDRPOU 3674008455) is governed by these General Terms and Conditions. Please read these General Terms and Conditions carefully before placing an order with MOJAVE. These General Terms and Conditions describe the delivery of products from MOJAVE, changes to the contract, possible ways to resolve problems, etc. If you believe that there is an error in these General Terms and Conditions, please contact MOJAVE for further discussion.

1.2 The purchase of goods through this website is governed by these General Terms and Conditions, which are exclusively reserved for the consumer (hereinafter referred to as “you”). You may only purchase goods on this website if you are at least 18 years of age (or, if younger, have a legal guardian).

1.3 The products can be delivered to most countries in the world as indicated on the order form (shipping).

1.4 The purchase of the Products is governed exclusively by the General Terms and Conditions published on the website.

1.5 MOJAVE reserves the right to make changes to the General Terms and Conditions at any time without giving notice. However, any changes will be effective only for purchases made after the date of publication of the new version of the General Terms and Conditions on the Internet.

If the Terms and Conditions are replaced by a new version, the previous version of the Terms and Conditions shall no longer apply, be valid or enforceable in respect of any purchases made after such previous version is removed from the website.

1.6 MOJAVE reserves the right to refuse to sell the Products if we have reason to believe that the purpose of the purchase is to copy MOJAVE's design or that the Products will be used in an illegal manner.

Making a purchase

2.1 Each Product offered for sale on the website can be viewed by clicking on a special link that displays a photo of the product, unit price, colors, dimensions.

2.2 The Products you have selected must be placed in a special section (hereinafter referred to as the “Shopping Cart”). The Shopping Cart must contain: a description of the Products, including details of the dimensions and one or more photos that clearly demonstrate the Products.

2.3 Digital photos of the Products provided on the website and in the shopping cart are for illustrative purposes only. Although MOJAVE has made every effort to display colors accurately, it cannot be guaranteed that the color display of the device accurately reflects the color of the products. Your products may differ slightly from these images.

2.4 To view your selected products and the total cost of your order, visit your shopping cart. The purchase process allows you to check and correct any errors before confirming your order with MOJAVE. Please read and check your order carefully at each stage of the purchase process. Before confirming the corresponding order (hereinafter referred to as the “Order”), please be careful to check the correctness of the contents of the shopping cart and fill out the order form in accordance with the instructions provided on the website.

2.5 The purchase process is completed as soon as you have clicked the last order confirmation button “Buy” (the “Buy Button”). Your Order with MOJAVE is also checked in the same way.

2.6 As a general rule, after clicking the Buy Button, the content of the order cannot be changed by you. However, upon receipt of your written request to change your order after clicking the Buy Button, we will try to facilitate the resolution of this issue if the order has not yet been shipped. MOJAVE does not guarantee the change or cancellation of the order after clicking the Buy Button.

2.7 Before confirming your order, you must confirm that you have read and accepted these Terms and Conditions. After completing the purchase process, you must save or print the Terms and Conditions.

2.8 The purchase process set forth in paragraph 3 must be fully completed. Failure to fulfill this obligation means that the order cannot be submitted to MOJAVE.

2.9 MOJAVE will use the personal information you provide: (i) to deliver the products; (ii) to process your payment; and (iii) to provide you with information about similar products if you have agreed to do so during the ordering process. You can opt out of receiving this information at any time by contacting MOJAVE. MOJAVE will only provide your personal information to third parties if the law either requires or permits MOJAVE.GROUP to do so.

2.10 You are aware that you are responsible for the accuracy and truthfulness of any data entered on the website or otherwise used at the time of purchase.

2.11 You are aware that you may have the opportunity to order products on the Website before they are commercially launched or distributed and placed on the market (“Pre-Ordered Products”). You acknowledge that such pre-ordered products are not yet available for general sale. Pre-Ordered Products are clearly identified and labeled on the Website through the phrase “Order” or “Pre-Ordered Product”. The pre-ordered product will be delivered to you on or before the estimated date specified in the product page description on the website at the time of ordering.

2.12 You acknowledge and agree that if you order a Pre-Order Product, the applicable price shown on the Website and displayed in the Shopping Cart section will be charged after you have clicked the Buy Button.

2.13 Any further details regarding payment, delivery and confirmation of pre-ordered products are provided below in the relevant sections.

2.14 You acknowledge and agree that, except as specifically provided herein for Pre-Ordered Products, the other provisions of these Terms and Conditions will apply to Pre-Ordered Products.

Performance

3.1 After you have confirmed your order and clicked the Purchase Button, the Order is submitted to MOJAVE for processing and cannot be further modified or canceled. The order made by you is processed only by MOJAVE if the entire purchase process was properly carried out and the website does not report any errors. After placing your order, you will receive an automatic email from MOJAVE confirming that your order has been accepted. However, please note that in the process of preparing the product for delivery, due to some unexpected events (for example, the only available Product is damaged/faulty), MOJAVE may not fulfill your order. In such a case, MOJAVE will immediately send you an offer to change or cancel your order, and in case of cancellation, refund you the full price of the order.

Price and payment method

4.1 Relevant prices are displayed in Ukrainian Hryvnia (UAH).

4.2 The prices displayed on the Website and in the Shopping Cart will be charged to you after you confirm your order by clicking the Buy Button.

4.3 MOJAVE accepts only those payment methods that are clearly indicated on the website.

4.4 To make a payment, you confirm and warrant that you are the owner of the account used for the purchase.

4.5 Purchased Products shall be shipped only after payment in full. In the event that, for any reason, you cannot be charged, the sale process will be automatically terminated and the sale will be canceled and you will be notified accordingly.

4.6 If one or more Products are unavailable, and if you decide not to cancel the entire Order, the difference between the amount charged and the cost of the available Products, as well as any associated shipping costs, will be refunded to you.

Shipping

5.1 MOJAVE uses the services of Nova Poshta for all deliveries within Ukraine.

5.2 5.2 Worldwide delivery is carried out by UKRPOSHTA. All orders are trackable.

5.3 For security reasons, MOJAVE cannot process any order to a post office address or accept any order that does not allow identification of the individual who is considered to be the recipient of the order and the corresponding address.

5.4 The Products shall be deemed delivered upon transfer by MOJAVE to the delivery courier. MOJAVE delivers the Products to the courier within 3 (three) business days from the date of payment for the Product. MOJAVE is not responsible for the loss or damage of the Products by the courier.

Product Compliance

6.1 After you have received the receipt from the courier, you must check the Products to ensure that they are the same as the ordered products and that they do not have any manufacturing defects or discrepancies.

6.2 If the delivered Product has a manufacturing defect or is not the size you ordered, you have the right to return or replace the Product (if available) free of charge. If you return the Product, the price charged will be refunded to you in full. It is understood that you will lose this right if you do not notify MOJAVE of the lack of conformity of the Product within 14 (fourteen) days from the date of delivery.

6.3 Products purchased with discounts cannot be returned or replaced unless they have a manufacturing defect.

Limitation of liability

7.1 MOJAVE shall not be liable for any loss or damage that you suffer as a result of MOJAVE's failure to comply with these Terms and Conditions, unless such failure is caused by MOJAVE's fault or negligent conduct.

7.2 MOJAVE delivers the Products for private use only. If you use the Products for resale or for any other commercial purposes, MOJAVE shall not be liable to you for any loss of profit, loss of business, business interruption or loss of business opportunities.

7.3 MOJAVE does not exclude or limit our liability to you in any way. This includes liability for: (i) death or personal injury caused by our negligence; (ii) fraud or fraudulent misrepresentation; (iii) violation of your legal rights in relation to the Products, including the right to receive the products as described and relevant information provided to you through MOJAVE; and (iv) defective products.

7.4 MOJAVE shall not be liable in case of your refusal to clear customs and pay import taxes, VAT (if applicable) and other import duties as provided by applicable law. MOJAVE shall not be liable in the event that the Products cannot be delivered to you by a carrier courier due to a ban in your country or any other restrictions on the import of such Products. In the cases listed in clause 7.4 of the General Terms and Conditions, the cost of the product and the cost of delivery are not refundable.

7.5 Subject to clause 7, and to the extent permitted by law, MOJAVE's total liability to you in respect of damages arising in connection with the General Terms and Conditions, contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no event exceed the total price of the Products ordered.

Product Authenticity and Intellectual Property Rights

8.1 MOJAVE guarantees the authenticity and high quality of all products offered for sale on the website.

8.2 The MOJAVE trademark, as well as all figurative and non-figurative marks and, in general, all other trademarks, illustrations, images and logos found on MOJAVE products, related accessories and/or packaging, whether registered or not, are and will remain the exclusive property of MOJAVE. Reproduction, in whole or in part, modification or use of these trademarks, illustrations, images and logos for any reason and with any support is strictly prohibited.
